3. Eligibility and Enrollment
3.1 Age Requirements
Our services are intended for students aged 16 and above. Students under 18 must have parental or guardian consent to enroll in our programs.
3.2 Enrollment Process
To enroll in our courses, you must:

- Meet any prerequisites specified for your chosen course
- Pay applicable fees as outlined in our fee schedule
- Agree to these Terms of Service

3.3 Course Availability
Course offerings, schedules, and availability are subject to change. We reserve the right to cancel courses due to insufficient enrollment or other circumstances beyond our control.
4. Fees and Payment
4.1 Course Fees
All course fees are listed in Australian Dollars (AUD) and include GST where applicable. Fees are subject to change with reasonable notice.
4.2 Payment Terms
- Full payment is required before course commencement unless alternative arrangements are made
- Payment plans may be available for certain courses upon approval
- Late payment fees may apply for overdue accounts
- We accept payment by credit card, bank transfer, or other approved methods
4.3 Refund Policy
Cooling-off Period: You may cancel your enrollment within 10 business days of signing up and receive a full refund, provided you have not attended more than 20% of your course.
Withdrawal Before Course Commencement:
- More than 14 days before start: 90% refund
- 7-14 days before start: 75% refund
- Less than 7 days before start: 50% refund
Withdrawal After Course Commencement:
- Within first week: 75% refund for unused portion
- After first week: 50% refund for unused portion
- After 25% course completion: No refund available
Special Circumstances: Refunds may be considered for medical emergencies, visa rejections, or other exceptional circumstances with appropriate documentation.
5. Student Responsibilities
5.1 Attendance and Participation
- Attend classes regularly and arrive punctually
- Notify instructors of anticipated absences
- Participate actively and respectfully in all learning activities
- Complete assignments and assessments as required
5.2 Conduct and Behavior
Students are expected to:
- Treat all staff, instructors, and fellow students with respect
- Maintain a positive learning environment
- Follow all classroom and facility rules
- Use appropriate language and behavior at all times
- Not disrupt classes or interfere with others' learning
5.3 Academic Integrity
Students must maintain academic honesty by:
- Completing all work independently unless group work is specified
- Not engaging in plagiarism or cheating
- Properly attributing sources in written work
- Not sharing assessment materials with other students

8. Intellectual Property

8.2 Student Work
You retain ownership of work you create as part of your studies. However, you grant InChicerva a non-exclusive license to use anonymized examples of student work for educational and promotional purposes.
9. Technology and Online Services
9.1 Online Platform Access
For online courses and services:
- You are responsible for providing reliable internet access and appropriate devices
- Technical requirements will be communicated prior to course commencement
- We provide technical support during business hours
- Service interruptions may occur for maintenance or technical issues
9.2 Account Security
- Keep your login credentials confidential
- Do not share your account with others
- Notify us immediately of any unauthorized access
- You are responsible for all activities under your account
10. Disciplinary Actions
InChicerva reserves the right to take disciplinary action, including suspension or termination of enrollment, for:
- Violation of these Terms of Service
- Inappropriate conduct or behavior
- Academic dishonesty
- Non-payment of fees
- Disruption of the learning environment
- Illegal activities on our premises or platforms
11. Force Majeure
InChicerva shall not be liable for any delay or failure to perform due to circumstances beyond our reasonable control, including but not limited to:
- Natural disasters, pandemics, or public health emergencies
- Government regulations or restrictions
- Labor strikes or disputes
- Technical failures or cyber attacks
- Acts of war or terrorism
12. Limitation of Liability
To the maximum extent permitted by law:
- InChicerva's total liability shall not exceed the fees paid by the student
- We are not liable for indirect, incidental, or consequential damages
- We do not guarantee specific learning outcomes or exam results
- Students participate in activities at their own risk
13. Consumer Rights
Under Australian Consumer Law, you have certain rights that cannot be excluded, including:
- Right to receive services with due care and skill
- Right to have services provided within a reasonable time
- Right to remedies if services fail to meet consumer guarantees
These Terms do not exclude, restrict, or modify any rights you have under Australian Consumer Law.
14. Dispute Resolution
14.1 Internal Complaints Process
If you have a complaint or concern:
- Contact your instructor or course coordinator first
- If unresolved, submit a written complaint to management
- We will investigate and respond within 10 business days
- An appeals process is available if you're unsatisfied with the outcome
14.2 External Resolution
If internal resolution is unsuccessful, you may seek assistance from:

- Australian Competition and Consumer Commission (ACCC)
- Relevant industry ombudsman
15. Changes to Terms
We may modify these Terms of Service from time to time. Changes will be communicated through:

- Email notification to enrolled students
- Notice displayed at our premises
Continued use of our services after changes take effect constitutes acceptance of the new terms.
16. Termination
16.1 By Student
You may terminate your enrollment subject to our refund policy outlined in Section 4.3.
16.2 By InChicerva
We may terminate your enrollment for breach of these Terms, with appropriate notice and opportunity to rectify where possible.
17. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Victoria.
18. Severability
If any provision of these Terms is found to be unenforceable, the remainder shall continue in full force and effect.
